The abduction of children from a parent’s care, or the risk of abduction can be a very stressful and emotive situation for any parent to find themselves in. Matters such as this have to be acted upon quickly as time is of the essence and if not acted upon immediately can result in the child being taken out the country.

Once instructed we can make an emergency Application, depending on the circumstances on the same day to the Court for an order to seize passports of the abductor and the child and an order to establish their location and arrange a port alert. We can further apply for an Order that prevents them from leaving the Country, until a full Court Hearing has taken place.
If the child has already been taken out the Country by the abductor, then the matter is somewhat more complicated, however we can still assist and make the necessary Application at the High Court under its inherent jurisdiction. The procedure that needs to be followed is different when the child has been taken into a Hague Convention Country and a non Hague Convention Country.
